1. Overview

Welcome to Engage, a research panel operated by PulseIQ Labs, Inc.
By creating an account, accessing, or using the Engage app (“App”) or related services (collectively, the “Service”), you agree to these Terms & Conditions (“Terms”).

If you do not agree, do not use Engage.
These Terms govern your participation as a panelist, your eligibility for rewards, and how your voice, likeness, and data may be used as part of our research and promotional activities.

2. Eligibility and Panel Admission

Engage is a curated, invite-only community of verified participants.
We value quality and authenticity over quantity.

To participate in Engage, you must:

  • Be at least 18 years old (or the age of majority in your jurisdiction).
  • Reside in a country where Engage operates.
  • Complete any required verification process (which may include voice, video, or LinkedIn verification).
  • Meet our quality, engagement, and identity requirements.

Selective Admission

We reserve the right, at our sole discretion, to:

  • Admit or deny any applicant’s participation in the Engage panel.
  • Limit the number of participants at any time.
  • Determine eligibility based on engagement quality, demographic needs, or data availability.

Being invited or previously accepted into Engage does not guarantee continued participation or eligibility for future studies.

Right to Discontinue Participation

We also reserve the right to suspend or discontinue your participation in any panel, program, or the entire Service at any time and for any reason, with or without notice.
This may include, but is not limited to:

  • Fraud prevention or identity concerns,
  • Low engagement or quality issues,
  • Inactive accounts,
  • Changes to research or operational needs.

Any unredeemed tokens or rewards may be forfeited upon removal, subject to applicable law.

3. Account Registration and Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.

You agree to:

  • Provide accurate, truthful information during registration.
  • Not impersonate or misrepresent yourself.
  • Not use the Service for unlawful, abusive, or fraudulent purposes.
  • Notify us promptly of any unauthorized use of your account.

We may suspend or terminate your account if we suspect fraud, abuse, or violations of these Terms.

4. Participation in Studies

As an Engage panelist, you may be invited to participate in voice-based conversations, short surveys, or data-enabled studies (collectively, “Studies”).

Participation is voluntary. You may choose which Studies to join and can withdraw at any time.

By participating, you agree that:

  • Your voice, image, and responses may be recorded.
  • Engage may analyze your responses, including transcriptions and derived insights.
  • Engage may use and share recordings and insights with research clients, as described in the Privacy Policy.

Engage reserves the right to monitor and moderate sessions for quality, compliance, and fraud prevention.

5. Rewards and Payments

Engage rewards you with tokens, cash equivalents, or digital gift cards (“Rewards”) for completing Studies or maintaining active data connections (e.g., connected apps, browser extension, bank data).

a. Earning Rewards

  • The amount and conditions of each Reward are displayed before participation.
  • Rewards may vary by study type, duration, or data connected.
  • Engage may withhold or reverse Rewards for fraudulent or incomplete participation.

b. Redeeming Rewards

  • Rewards may be redeemed through approved partners (e.g., Tremendous, Plaid, or similar).
  • Redemptions are final once submitted. Tokens are non-refundable and non-transferable.
  • Engage is not responsible for delays or issues caused by third-party payment providers.

c. Taxes

You are solely responsible for reporting and paying any applicable taxes associated with your Rewards.

6. Data Connections and Consent

Engage may allow you to connect external data sources (e.g., bank transactions, browsing history, email receipts, or health data) to enhance study relevance.

By connecting these accounts, you:

  • Authorize Engage and its partners (e.g., Plaid) to securely access the approved categories of data.
  • Understand that connecting is optional but may increase your eligibility for Studies.
  • May disconnect at any time, after which no new data will be collected.

7. Use of Voice, Image, and Likeness

a. Research Use

You grant Engage and its clients a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, and display your recordings (voice, video, and transcripts) solely for research and internal client use, including highlight reels, presentations, and insight reports.

b. Promotional Use

Engage may occasionally seek additional, separate written consent to use your recordings or likeness in marketing or promotional materials (e.g., website, social media, investor presentations).
You may withdraw this promotional consent at any time for future use.

8. Ownership of Content

  • You retain ownership of your individual responses and recordings.
  • By submitting content, you grant Engage a license to use, reproduce, distribute, and display that content for research, analysis, or promotional purposes (as applicable under your consents).
  • Engage owns all aggregated, anonymized, or derived data, insights, and analytics generated through the Service.

9. Intellectual Property

All content and software provided by Engage, including the App, logo, branding, and user interface, are the property of PulseIQ Labs, Inc. and protected by copyright and trademark laws.

You may not copy, modify, reverse engineer, or distribute any part of the Service without our written permission.

10. Fraud and Misuse

Engage maintains a zero-tolerance policy for fraud, misrepresentation, or abusive behavior. Examples include:

  • Submitting false responses or voice data.
  • Using multiple or fake accounts.
  • Manipulating study participation or referral systems.

Violations may result in:

  • Termination of your account.
  • Forfeiture of Rewards.
  • Reporting to applicable authorities.

11. Termination

You may terminate your account at any time by deleting it in the app or contacting privacy@joinengage.io.

Engage may suspend or terminate your account if:

  • You violate these Terms.
  • You engage in fraudulent activity.
  • You fail to meet ongoing participation requirements.
  • We determine, at our sole discretion, that continued participation is not in the best interest of the panel or its members.

Upon termination:

  • You will lose access to your account and any unredeemed tokens.
  • Previously collected data may be retained and used as outlined in the Privacy Policy.

12. Disclaimers

The Engage Service is provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee:

  • Availability or uninterrupted operation of the Service.
  • Eligibility for any specific Studies or rewards.
  • Accuracy or completeness of client opportunities or research materials.

13. Limitation of Liability

To the fullest extent permitted by law, PulseIQ Labs, Inc. and its affiliates shall not be liable for any:

  • Indirect, incidental, special, or consequential damages,
  • Lost profits or data, or
  • Issues arising from third-party integrations or payment systems.

In no event will our total liability exceed $100 USD or the amount you earned through Engage in the preceding 12 months, whichever is greater.

14. Indemnification

You agree to defend, indemnify, and hold harmless PulseIQ Labs, Inc., its affiliates, officers, and partners from any claims or liabilities arising from:

  • Your use of the Service,
  • Your violation of these Terms, or
  • Your misuse of Engage data or materials.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Any disputes shall be resolved through binding arbitration under the rules of the American Arbitration Association.
You waive the right to participate in class actions or jury trials.

16. Modifications to the Service

We may modify, suspend, or discontinue parts of the Service at any time, with or without notice.
We are not liable for any resulting loss of access, data, or Rewards.

17. Changes to These Terms

We may update these Terms periodically.
If we make material changes, we’ll notify you via the App or email and update the effective date.
Your continued use of Engage after such updates constitutes acceptance.
